These Terms of Service ("Terms") govern your use of the Melde mobile application ("the App"), operated by Melde Inc., an Ontario corporation (OCN: 1001514033). By creating an account or using the App, you agree to these Terms.
Melde is an AI-powered fitness coaching application that analyzes data from your wearable devices and fitness platforms to provide personalized training plans, daily coaching guidance, and health insights.
Important: Melde is a fitness coaching tool, not a medical device. The App does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before starting or modifying any exercise program, especially if you have pre-existing health conditions.
You must be at least 18 years old to use Melde. By creating an account, you represent that you meet this age requirement.
You are responsible for maintaining the security of your account credentials. You agree to notify us immediately if you suspect unauthorized access to your account. We are not liable for losses resulting from unauthorized use of your account.
You may only create one account per person. Accounts are non-transferable.
You agree to use the App only for its intended purpose of personal fitness coaching. You may not:
Not Medical Advice: All coaching recommendations, training plans, and health insights provided by the App are generated by artificial intelligence for informational purposes only. They do not constitute medical advice, and should not be used as a substitute for professional medical consultation.
Exercise Risks: Physical exercise carries inherent risks including injury, illness, and in rare cases, death. You acknowledge these risks and agree to exercise at your own discretion. If you experience pain, dizziness, shortness of breath, or other concerning symptoms during exercise, stop immediately and seek medical attention.
AI Limitations: AI-generated recommendations may contain errors or be inappropriate for your specific health situation. Known limitations include: the AI may not detect all contraindicated exercises for your condition; recommendations depend on the accuracy of your connected device data; coaching may be less effective during the initial data collection period; and the AI cannot account for factors not captured by your wearables (such as illness, medication, or environmental conditions). The App uses safety guardrails (including heart rate limits, recovery checks, and zone label verification), but these are not infallible. You are ultimately responsible for listening to your body and making safe training decisions.
Data Accuracy: The accuracy of coaching recommendations depends on the accuracy of data from your connected devices. We are not responsible for inaccurate advice resulting from faulty or miscalibrated device data. Derived metrics (such as training load scores and recovery status) are computed from device data and are estimates, not clinical measurements.
Science Knowledge Base: Coaching recommendations are informed by a curated library of peer-reviewed sports science research. The AI synthesizes this research with your personal data to provide evidence-based guidance. The AI coach references research domains generally without citing specific papers.
AI Usage Limits: To manage service quality and costs, the App applies per-user daily limits on AI coaching requests. If you reach a usage limit, real-time AI features may be temporarily reduced until the next day. Previously cached coaching guidance remains available during any rate-limited period.
The App integrates with third-party services including Terra, Garmin, Oura, Peloton, Apple HealthKit, Anthropic, and OpenAI. Your use of these services is governed by their respective terms of service, which may be updated independently by those providers. We are not responsible for the availability, accuracy, or security of third-party services. Additional wearable integrations may be added in future updates.
Connecting a third-party device or platform authorizes us to access the health data categories described in our Privacy Policy. You can revoke this access at any time from Settings.
Service Degradation: If a third-party service experiences downtime, API changes, or discontinuation, the App's functionality may be temporarily reduced. We will make reasonable efforts to restore full functionality but are not liable for coaching interruptions caused by third-party service failures.
Apple EULA Acknowledgment: You acknowledge that these Terms are between you and Melde Inc. only, and not with Apple Inc. Melde Inc., not Apple, is solely responsible for the App and its content. You acknowledge that Apple has no obligation to furnish any maintenance and support services for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, consumer protection claims, intellectual property claims, or any claim that the App fails to conform to legal or regulatory requirements. Apple and its subsidiaries are third-party beneficiaries of these Terms, and Apple will have the right to enforce these Terms against you as a third-party beneficiary.
Free Trial: New users may be eligible for a free trial period. The duration and terms of the free trial will be specified at the time of sign-up. At the end of the free trial, your subscription will automatically convert to a paid auto-renewable subscription unless you cancel before the trial period ends.
Subscription: Melde is offered as an auto-renewable subscription through the Apple App Store. Payment is charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless you cancel at least 24 hours before the end of the current billing period. You can manage and cancel your subscription in your Apple ID account settings.
Pricing: Current subscription pricing is displayed in the App and on the App Store listing. Prices may vary by region and are subject to change. We will notify you of any price increases at least 30 days in advance. Price changes take effect at the start of the next billing cycle following the notice period.
Refunds: All purchases are processed by Apple. Refund requests must be submitted through Apple's standard refund process. We do not process refunds directly.
You may report AI-generated content that you believe is inaccurate, harmful, or inappropriate using the Report button on any coaching message. We review reported content to improve coaching quality and safety. We reserve the right to modify AI coaching behavior in response to reports. Abuse of the reporting system (such as excessive or frivolous reports) may result in account restrictions.
The App, including its design, code, AI models, training plans, and content, is owned by Melde Inc. and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
Your personal health data remains your property. By using the App, you grant us a limited license to process your data as described in our Privacy Policy for the sole purpose of providing the coaching service.
AI-Generated Content: Training plans, coaching advice, and other content generated by the AI are provided for your personal use. We do not guarantee that AI-generated content is unique or eligible for copyright protection.
We strive to maintain high availability but do not guarantee uninterrupted service. The App may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We will make reasonable efforts to notify you of planned downtime. During periods of reduced service, previously cached coaching guidance may be served, and real-time AI features may be temporarily unavailable.
To the maximum extent permitted by law, Melde Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to physical injury, health complications, data loss, or reliance on AI-generated advice.
Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim, or $50 CAD, whichever is greater.
You may delete your account at any time from Settings → Delete Account & Data. This permanently removes all your data from our servers within 24 hours.
We reserve the right to suspend or terminate accounts that violate these Terms, with notice where practicable. Upon termination, your right to use the App ceases immediately.
We may update these Terms from time to time. Material changes will be communicated via in-app notification or email at least 14 days before taking effect. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, sitting in the City of Toronto.
Nothing in these Terms prevents you from exercising your rights under applicable consumer protection legislation, including the Ontario Consumer Protection Act, 2002.
